Terms and Conditions (GTC)

§ 1 Scope

These general terms and conditions (GTC) apply to all contracts, deliveries and services between the Antikstore (hereinafter "seller") and the customer (hereinafter "buyer") in the version valid at the time of the order.

§ 2 Conclusion of contract

The seller's offers are subject to change and non-binding. The buyer submits a binding purchase offer by completing the order. The seller can accept this offer within two weeks by delivering the ordered goods or by sending the buyer an order confirmation.

§ 3 Right of Withdrawal

The buyer has a right of withdrawal in accordance with the cancellation policy. You can find these on the left side of the homepage.

§ 4 Delivery

Delivery will be made within the period specified in the item description. If delivery is not possible for reasons for which the seller is not responsible, the buyer will be informed immediately. The seller reserves the right to withdraw from the obligation to perform the contract if the goods are not available despite having been properly ordered. In this case, the seller will immediately inform the buyer of the non-availability and immediately refund any consideration already received.

§ 5 Retention of title

The delivered goods remain the property of the seller until the purchase price has been paid in full.

§ 6 Warranty

The seller guarantees that the goods are free of material and legal defects upon delivery. The buyer must inspect the goods for defects immediately upon receipt and notify the seller of any defects immediately. In the case of justified notices of defects, the seller has the right to rectification or replacement delivery.

§ 7 Liability

The seller is liable for damage caused intentionally or through gross negligence. Otherwise, the liability of the seller is limited to the amount of the purchase price.

§ 9 Severability Clause

Should a provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the ineffective provision, an effective provision shall be deemed to have been agreed which comes as close as possible to the economic purpose of the ineffective provision.

§ 10 Place of Jurisdiction and Applicable Law

The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention. If the buyer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is the district court in whose district the seller's registered office is located.
